Hydroxycut Injury Lawsuits
San Antonio Personal Injury Attorney Michael Grossman Discusses Hydroxycut Injuries

If you have suffered an injury while taking any product containing Hydroxycut, you may be eligible to seek compensation from the drug’s manufacturer if it turns out that your injury was caused by Hydroxycut.
Iovate Health Sciences USA Inc., Hydroxycut’s manufacturer, recently announced a voluntary recall of almost their entire line of Hydroxycut products and informed the U.S. Food and Drug Administration of numerous health risks associated with the drug. Hydroxycut is marketed as a weight loss aid, but recent studies indicate that it can cause serious liver, kidney, and other organ damage. At least one death has been linked to severe liver failure caused by Hydroxycut. Some of the products under recall include:
- Hydroxycut Hardcore Liquid Caplets
- Hydroxycut Max Liquid Caplets
- Hydroxycut Regular Drink Packets
- Hydroxycut Caffeine-Free Drink Packets
- Hydroxycut Hardcore RTDs (Ready-to-Drink)
- Hydroxycut Max Aqua Shed
- Hydroxycut Regular Rapid Release Caplets
- Hydroxycut Caffeine-Free Rapid Release Caplets
- Hydroxycut 24
- Hydroxycut Carb Control
- Hydroxycut Natural
- Hydroxycut Hardcore Drink Packets (Ignition Stix)
- Hydroxycut Max Drink Packets
- Hydroxycut Liquid Shots
How did Such a Dangerous Drug Reach Consumers?
Unlike other medications, dietary supplements are not regulated by the Food and Drug Administration, nor do they require Food and Drug Administration approval in order to be sold. Before the drug is released, the only safety information about the drug comes from the manufacturer; and after release, additional information is only acquired if third parties conduct independent surveys. But these surveys are typically only conducted after a significant number of injuries have been linked to the drug.

In most cases, the information provided by the drug’s manufacturer is entirely inadequate. Safety testing is extremely expensive, and many drug manufacturers will choose to skip safety testing in order to get their drug on the market faster. Even more deceitful drug companies may choose to conduct their own testing in an unethical manner in order to make the drug appear safer than it actually is.
Despite the lack of FDA regulation, Iovate is responsible for the safety of their product, and people who have been injured by Hydroxycut can potentially seek compensation through a drug liability lawsuit. However, proving that you have been injured by Hydroxycut is a difficult process. A relatively small number of injuries have been reported, but it is estimated that many more people may be injured and not realize it. The organ damage caused by Hydroxycut can take a long time to manifest symptoms. Additionally, doctors have not been aware of the dangers of Hydroxycut in the past, and so they have been unable to link organ damage back to the drug. In short, there may be many undiagnosed cases of people injured or killed due to Hydroxycut.

$350,000.00 Recovery - Product Liability (Back Injury Resulting in Surgery)
A young woman suffered a back injury that required corrective surgery following a boating accident. The boat in question sped out of control and crashed into a landmass, throwing our client from the boat, as the result of a stuck throttle. Upon inspection of the boat, it was determined that a poor design led to the malfunction and a product liability lawsuit was brought against the manufacturer. The defendants argued that the boat was inappropriately piloted, however, the physical evidence depicted the cause of the accident quite clearly and the case was successfully resolved.

$3,200,000.00 Recovery - Wrongful Death / Automobile Accident
Our attorneys were hired to represent the family of a middle aged woman who was killed in a car accident. The incident occurred as another vehicle struck the car that the decedent was a passenger in, head-on on the passenger side. The impact resulted in catastrophic injuries which claimed the life of the decedent.
Our attorneys were hired soon after the accident and we launched a full investigation. Through the course of our investigation, it was soon determined that the head-on collision was caused a failed component in the defendant's vehicle (the particulars of which cannot be elaborated upon per the resolution agreement). Suit was filed against the manufacturer of said component and litigation commenced. The case was successfully resolved through litigation.
