You might be surprised to learn that most personal injury cases never go to court – and it is not often necessary to take a case that far.
The methods used by attorneys to resolve a case out of court are called alternative dispute resolution procedures, and they are governed by the Texas Alternative Dispute Resolution Procedures Act. Numerous methods of alternative dispute resolution exist (such as mediation and arbitration), but they all share the same general structure: both sides of a legal dispute meet with a neutral third party who then helps both sides reach a mutually agreeable settlement without taking a case all the way to trial.
There can be many reasons to resolve a case outside of court. Primarily, alternative dispute resolution is typically less stressful for the plaintiff (and the defendant). The process is less formal, there will be fewer legal fees, and you can usually reach a settlement faster than if you took the case to court. Furthermore, trial always includes an element of uncertainty since the case is ultimately in the hands of a jury. Generally, when an experienced attorney takes a case, he or she begins preparing a lawsuit immediately, even if the plaintiff does not intend to file one. The attorney can then use the prepared lawsuit as leverage when negotiating for a settlement.
While alternative dispute resolution methods are often beneficial, you should not think that they are the answer to every case.
