Vicarious liability is a doctrine that can hold a party responsible for the negligent actions (or inaction) of another under certain circumstances.
Vicarious liability is often involved in personal injury lawsuits, and is a necessary component of many strong cases. For example, consider an accident wherein a person is hurt in a traffic accident caused by a delivery truck. If the driver of the truck caused the accident, he or she would likely be held liable, but the company that employed the driver may be liable as well.
Vicarious liability is typically invoked in traffic accidents involving commercial vehicles, though it can be found in other types of accidents as well. For instance, let us say that Mr. Smith loans his car to his friend Mr. Jones so Mr. Jones can run some errands. Mr. Smith knows that Mr. Jones does not have a license and drives recklessly, but he loans the vehicle anyway. If Mr. Jones then causes an accident, anyone injured in that accident could hold both Mr. Smith and Mr. Jones liable. Mr. Smith would be liable for loaning a vehicle to a known reckless driver. This is another form of vicarious liability called liability for negligent entrustment.
